Booking services
Where OstWestfalenLippe GmbH, through its Teutoburger Wald Tourism division, or intermediary online booking platforms such as booking.com or BestFewo, or local and regional tourism and booking agencies, arrange accommodation, package deals or other offers, the legal provisions applicable to travel agents shall apply to the legal relationship with the guest within the scope of the booking agreement.
As agents, the aforementioned bodies are liable for the booking itself, but not for the service booked. The legal relationship between the guest and the accommodation provider is governed by the statutory provisions and, where validly agreed, by the general terms and conditions of the respective provider.
Package deals
In the case of package deals, the responsible tour operator – who is your contractual partner upon booking – is named in the relevant offer or in the booking confirmation.
The legal and contractual relationship between the guest and the provider of the package (tour operator) is governed by the relevant statutory provisions (in the case of package holidays, in particular Sections 651a–m of the German Civil Code (BGB) and Sections 4–11 of the Ordinance on Information Requirements under Civil Law) and, where validly agreed, the provider’s General Terms and Conditions.
Please note the following special feature: Providers of package holidays are exempt from the statutory obligation to provide so-called customer funds protection (and the resulting obligation to issue a so-called security certificate) if the guest’s contractual partner is a tourism office that is a direct institution (e.g. a spa, transport or tourism office) of a city, a municipality or another local authority. Of course, your deposit or advance payment for package deals is also secure with such providers.
